Clare Daly has issued a Statement
Result of Test 30% below limit!
Part of her statement which I for one find very worrying.
I was breathalysed but the equipment didn’t register a reading. I was arrested and handcuffed on the side of the road. I objected to being handcuffed and stated that I would willingly go to the Garda station. I was told by the arresting Garda that this was ‘procedure’.
I was brought in a patrol car to the Kilmainham Garda Station – within 300 metres distance. At one point I was placed in a cell on my own. A doctor was called and I provided a urine sample. When I was released a female Garda told me to ‘come back when you are sober’.
I believe that the Gardai implementing road safety have a job to do and I support them. However, I object strongly to the arrest, handcuffing and release of information re the arrest on suspicion of drink driving to the tabloid press early on Tuesday. My legal advice is that none of this is ‘procedure’.
I believe that this was a deliberate attempt to discredit a left-wing TD who has raised issues of malpractice within the Garda Siochana. This information could only have come from within the Gardai.

I have received the official result of the test on the urine sample provided and the result is 45 milligrammes per 100 millilitres of urine, which is 33% below the allowable limit – 67 milligrammes
Its pretty poor, although not surprising that the fact she was stopped for Drink Driving reached the papers very quickly, well before the test results were out.

Good to see Daly being vindicated. It would be nice to see the Garda Ombudsman roll a head or two as a result of the leak to the media.

Yes and the fact that aside from the slur about the drink driving the facts about the breathalyser are different between Dalys statement and the report in the Herald.

“She did not provide a breath sample to gardai but agreed to provide a urine sample when she was taken to Kilmainham Garda Station. ”
“It is understood she was unable to take the breath test and opted to provide a urine sample.”
There was no mention there of the breathalyser not registering a reading and the implication was that Daly refused to take one or in the case of ‘unable to take the breath test ‘ you could read all sorts into it.
Hopefully the papers get sued.

Very poor on the cops part. Very poor. The handcuffing was well out of order in my view. The leaking too. Fookers should be thrun out but they won’t be.

The unnecessary use of a restraint such as handcuffs is an assault and would be the grounds for a complaint to the Ombudsman.

Can think of around 160 TDs would never in a million years have been handcuffed.
Likewise the Mail for example publishes a fair amount of salacious stuff of varying importance that is routinely ignored by the wider media let alone get anywhere near the RTÉ main evening news. Lot more then Shady Síochána.
Even last month the papers had Regina Doherty’s debts but only the Independent mentioned the illegal Director’s loan she took from the company. Goldhawk had that back in June.

The Irish Times and Harry McGee and Jason Kennedy don’t cover themselves in glory with their sneering report on Clare Daly’s vindication – I’m not linking so as to deprive the IT of revenue.
These two idiots refer to Clare Daly’s ‘long statement released this afternoon’ and link to said statement which is 457 words long. Their report is 567 long. It’s interesting that professional journalists would consider reading 457 words – shorter than many comments here – to be ‘long’. I suppose it says something about the work ethic at the IT!

I presume they’re hoping if they call it a ‘long’ statement, nobody will click on it; god knows they won’t be anxious to draw attention to Garda corruption and harassment of left-wing activists, wouldn’t really be the IT’s bag that sort of thing.

It’s naïveté in the extreme to consider this a vindication. Her urine alcohol-level was more than *twice* the limit allowed for inexperienced drivers. Extrapolating back to the point in time at which she got behind the wheel, it would have been even higher.
(And before anyone cries libel, the rate of metaboliztion of alcohol to acetaldehyde by the liver is an estabilished scientific fact – even PdR’s and Jeffrey Archer’s legal teams combined couldn’t magic up a libel case that contradicts basic science).
The reason for the lower threshold for inexperienced drivers, and indeed for the downward trend towards zero tolerance in many European countries, is that *any* alcohol impairs the driver’s ability to drive safely and puts other road users at risk.
And her faux umbrage at the female Garda telling her to ‘come back when you are sober’ is just risible – by her own admission, she was not sober at the time. And clearly she was uncertain herself as to whether she was below the limit, otherwise she wouldn’t have bothered with the home-measure of hot-whiskey story.

Yeah, he’s a wonder alright. It’s funny, I used to have some respect for the guy, thought he was pushing the envelope but wasn’t dishonest, but the last year was a serious eye-opener. The trolling just got too obvious, too designed to provoke a response, and also just too mean-spirited. Exhibit A, the comment above he made.

Ming said he had umpteen calls from journalists when the story originally broke but none today. First phone call on the matter was apparently from a Guard thanking him and the rest.

Two points:
1) The cops are daily leaking details of cases to their chums in the newspapers – needs to be stopped by Garda Omdudsman also;
2) Wonder if the Guards were breathalysing people leaving the Dáil (Dáil Bar) the morning of the all-night Promissory Note sitting.

It was I think some gardai who leaked the waiving of points. And was not a FG TD caught leaving the Dail with drink a while ago.
