There is something particularly obnoxious about the Department of Health.
When the Department of Education lost an equality case about a scheme it ran, and when the Department of Social Protection settled a case it was going to lose about a scheme it operated, both of them had enough respect for the law to go and get the Equal Status Acts amended by adding exemptions to make their schemes legal. Now, that is not a great response, but it shows at least a respect for the idea of law. The Department of Health has so much contempt for the law that it wouldn’t even get the Equal Satus Act changed to take its schemes out of its remit.
There is no respect for the law by this Government. Regardless of that side one was on in the Children’s Referendum the State was found to have breeched Mc Kenna – ie broke the law and carried on as if nothing had happened.
They continually say that they can’t interfer with pensions, bonus’s etc because of the Constitutional protection for property rights yet the overnight legislation to liquidate Anglo blatantly tramples over property rights and removes recourse to the Courts.
